All models, actors, actresses and other persons that appear in any visual depiction, whether of actual or simulated sexual behavior or otherwise, that appears on the website were over the age of eighteen years at the time of the creation of such.

Exemption: Content Produced by Third Parties

Referent to 18 U.S.C. § 2257, the operators of the website are neither the primary nor secondary "producers" of any photos or videos depicting real or simulated sexual conduct displayed hereon. In the case of content provided by third-party users of the website, whether explicitly sexual in nature or otherwise, the operators and owners of hqtrannytube.com confine their activities to the transmission, storage, retrieval, hosting and/or formatting of that content. All parts of the website that display user-furnished content are under the control of the associated user. The operators of hqtrannytube.com are therefore excluded from compliance with Section 2257 records keeping and labeling obligations as described in 28 C.F.R. §75.1(c)(4). In keeping with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c), the operator of hqtrannytube.com may take down any material which is considered illegal, defamatory, indecent, harmful or otherwise in violation of the website's terms of use and/or policies.

The visual depictions displayed on the website are not bound by the provision of 18 U.S.C. §§2257, 2257A and/or 28 C.F.R. §75, because: 1) they do not portray activity as specifically listed in 18 U.S.C §2256 (2)(A) (i) through (iv); 2) they do not portray activity as specifically listed in 18 U.S.C. §2257A produced after March 19, 2009; 3) they do not portray activity listed in 18 U.S.C. §2256(2)(A)(v) produced after March 19, 2009; 4) the visual depictions were created prior to July 3, 1995.
